Terms of Use & End User License Agreement
These terms ("Terms") are an agreement between you and Coop7, LLC ("Coop7", "we", "us"). They govern your use of our mobile apps (each an "App") and the website coop7.com. By downloading or using an App, you agree to these Terms. If you do not agree, do not use the App.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use each App for your personal, non-commercial use, on devices you own or control, as permitted by the usage rules of the Apple App Store or Google Play (the "App Store"). The App is licensed to you, not sold.
2. Restrictions
You agree not to:
- copy, modify, distribute, sell, rent or sublicense the App;
- reverse engineer, decompile or try to extract the source code, except where the law expressly permits it;
- use cheats, exploits, bots or unauthorized software to alter the App or gain an advantage;
- use the App for any unlawful purpose or in a way that harms the App, other users, or Coop7.
3. In-app purchases and virtual items
An App may offer virtual items, such as in-game currency, passes, upgrades or content, for purchase. Virtual items are a limited license to use features inside the App. They have no real-world monetary value, cannot be exchanged for cash, and cannot be transferred outside the App. In-game earnings, including anything won in a skill-based activity such as Side Jobs in Eggz Farm Simulation, are in-game currency only. Purchases are processed by the App Store and are subject to its terms. Except as required by law or by the App Store's refund policy, all purchases are final. Refund requests for App Store purchases must be made through Apple or Google.
Consumable items you have bought are yours to use in the App whether or not you hold a subscription. Ending a subscription closes only the subscription features.
4. Subscriptions
If an App offers an auto-renewable subscription:
- The price and billing period are shown before you confirm the purchase.
- Payment is charged to your Apple Account or Google account when you confirm the purchase.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the current period ends.
- You can manage or cancel subscriptions in your App Store account settings. Deleting the App does not cancel a subscription.
- If a free trial is offered, any unused part of the trial ends when you buy a subscription.
5. Simulations and third-party data
Some Apps, including Eggz Farm Simulation, use real-world data such as maps, satellite imagery, land and soil information, weather and natural hazard events for a place chosen by the game. This data comes from third parties and may be incomplete, delayed or inaccurate. Simulations are for entertainment and education only. They are not agricultural, financial, weather-safety or professional advice.
6. Privacy
Our Privacy Policy explains how we handle your information and forms part of these Terms.
7. Intellectual property
The Apps, including their code, design, graphics, text and audio, belong to Coop7 or its licensors and are protected by intellectual property laws. "Coop7" and our app names and logos are our trademarks. These Terms do not give you any rights to them beyond the license in Section 1.
8. Updates and availability
We may update, change or stop offering an App or any feature at any time. Some updates may be required to keep using the App. We do not guarantee that an App will always be available or free of errors.
9. Termination
Your license lasts until you or we end it. It ends automatically if you break these Terms. When it ends, you must stop using and delete the App. Sections 3, 5, 7, 10, 11 and 13 continue to apply after termination.
10. Disclaimer of warranties
To the maximum extent permitted by law, the Apps are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, Coop7 will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Apps. Our total liability for any claim relating to the Apps will not exceed the greater of the amount you paid for the App and related purchases in the 12 months before the claim, or US $50.
Some jurisdictions do not allow these exclusions or limits, so they may not apply to you.
12. Apple App Store terms
If you got the App from the Apple App Store, you and Coop7 also agree that:
- These Terms are between you and Coop7 only, not Apple. Coop7, not Apple, is solely responsible for the App and its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- Coop7, not Apple, is responsible for any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- Coop7, not Apple, is responsible for investigating, defending, settling and discharging any claim that the App infringes a third party's intellectual property rights.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right to enforce them against you.
13. Governing law
These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Utah County, Utah, unless the law where you live requires otherwise.
14. Changes to these Terms
We may update these Terms. We will change the effective date above. If the changes are significant, we will also give notice in the App. If you continue to use the App after changes take effect, you accept the updated Terms.
